2008 DUCATI SUPERBIKE CONCORSO TERMS AND CONDITIONS
1. Contest is open to all individual owners of a Ducati Superbike (models: 750 Bevels, 900 Bevels, TT1, TT2, F1, Supermonos, Belt Drive 2-Valve SuperSports, 851, 888, 748, 749, 916, 996, 998, 999, 848, 1098, Desmosedici RR) with OEM frame and Ducati motor built from 1972 to 2008. Entrants must be at least the age of majority in their jurisdiction of residence, possess a valid motorcycle license, and be a legal resident of the United States for the duration of the Ducati Superbike Concorso. Employees, officers, and directors of Ducati North America and its parent, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate. Title or, in the exception of title being non-existent, bill of sale must show entrant as individual owner of entered bike. Bikes registered to any dealership, corporation, LLC, financial institution flooring plan, etc. will NOT be eligible. Bikes not located in the United States for the duration of the Ducati Superbike Concorso will NOT be eligible.
2. The 2008 Ducati Superbike Concorso begins on 9:00AM PT on January 24, 2008, and ends on the date of the last Regional Round, which shall be on or about September 15, 2008. Entries should be received by Ducati North America no later than 11:59PM PT on the posted Entry Deadline as it pertains to the specific Ducati Superbike Concorso round for which you're applying. Motorcycle event dates with Ducati Superbike Concorso competitions are listed on Ducati North America website. Ducati North America may change the dates of the Ducati Superbike Concorso rounds at its discretion. Void where prohibited. All federal, state, and local laws and regulations apply.
3. A copy of the bike's title MUST be submitted with entry application. Bill of sale may be substituted for title only in the exception that no title exists for the bike. No motorcycle will be accepted without a copy of the title or valid substitution as outlined above. You must also submit four digital photos of your bike to Ducati North America. As an exception, the "Online Round," as defined later in the Rules, requires that no less than six digital photos be submitted to Ducati North America for consideration in the Online Round.
4. Ducati North America retains the sole right to determine an entrant's eligibility and acceptance in the Ducati Superbike Concorso as well as the right to disqualify any entrant at any time during the competition for any reason in its sole discretion, including for any violation of the Contest rules.
5. Entrants may apply to enter any and all five rounds of the Ducati Superbike Concorso; there is no limit to how many times you may enter.
6. All entered bikes MUST be powered by a Ducati motor and retain the "essential" Ducati OEM frame. Alterations to the frame will be allowed, including, but not be limited to, lengthening or "stretching." Any alteration of the bike's frame MUST be noted on entry request, and acceptance will be solely determined by Ducati North America. All bikes submitted for entry consideration MUST be in safe working condition and will be required to demonstrate their ability to operate; no exceptions.
7. No Superbike accepted in any round of the Ducati Superbike Concorso can be displayed in the Ducati Superbike Concorso booth with "commercial" materials or any display stands other than a front or rear stand. This includes, but is not limited to, information stands endorsing any dealership or Ducati North America, any display stand other than a rear or front motorcycle stand, and commercial handouts placed near the bike. All entrants MUST provide a solid rear and/or front stand to display their bike. Ducati North America will not provide bike stands. Bikes may be exposed to crowds and natural elements. It is the responsibility of the owner to provide cover for their bike if they wish to limit exposure. Ducati North America does not guarantee the availability of bike shelter.
8. Bikes selected for regional rounds of the Ducati Superbike Concorso must be brought to the hosting event location within the time frame indicated by Ducati show officials. All entrants must remove their bikes within two hours of completion of the show. Ducati will not prepare the bikes for the show, so it is the individual's responsibility to bring the bike to the event in "show condition." We will not be able to polish, clean or repair any entrant's bike. Bikes may be required to meet other certain criteria at each given location depending on local codes and laws. Ducati will not pay any expenses in connection with transporting bikes to the regional rounds.
9. Of the 5 rounds, one will take place "online" and will not have any specific physical location. To enter the Online Round, entrants must register via the http://ducatiusa.com/ website and submit 6 photos (left side, right side, front, rear and two detail shots of the owners choice) of the motorcycle, in addition to normal standard regional round informational requirements. Ducati will own all rights in the photographs. Online Rounds submission will be accepted beginning 12:00AM midnight PT April 7, 2008 at a site designated on http://ducatiusa.com/ and will stop being accepted 11:59PM PT April 28, 2008. Not all entries for the Online Round will be selected to participate in the actual Online Round competition. Selected entries and pictures thereof will be posted online with people's choice voting being tabulated through votes made on a website. Judging and resultant actions will otherwise be consistent with the regional rounds and include exceptions and as outlined hereafter.
10. Bikes will be viewed at each regional round of the Ducati Superbike Concorso by a team of judges selected by Ducati North America. Bikes will be judged based on a balance of: originality, emotion, personal appeal, modifications, prior use, beauty, sound, and other criteria the judges deem appropriate.
11. The judges will choose one "Overall Winner" of each round of the Ducati Superbike Concorso. In addition, runner-up winners may, but are not required to be, chosen for each of 6 subcategories: "Taglioni Award (Competition Superbikes)," "Cook Neilson Award (Pre-1988 Superbikes)," "Troy Bayliss Award (1988-2007 Superbikes)," "Casey Stoner Award (2007-2008 Superbikes and Desmosedici RR)," "Ducati Passion Award (bike must be ridden to the Regional Round and total bike miles will be considered)," and "Ducati 'Bella' Award (for extraordinary external beauty)."
12. At each round of the Ducati Superbike Concorso the general show-going public will be allowed to vote for their favorite Superbike. The judges will take the public votes into consideration when choosing the winner. Public votes will represent one of the many criteria considered by the judges. Public votes will be tallied and a "People's Choice" award for the bike which receives the most votes will be announced at the event.
13. For each of the five 2008 Ducati Superbike Concorso rounds, one of each of the following prizes will be awarded.

For each of the five 2008 Ducati Superbike Concorso rounds, one of each of the following prizes may be awarded.
Runner Up (Taglioni Award / Competition Superbikes)—$500 Ducati Performance Gift Certificate
Runner Up (Cook Neilson Award / Pre-1988 Superbikes)—$500 Ducati Performance Gift Certificate
Runner Up (Troy Bayliss Award / 1988-2007 Superbikes)—$500 Ducati Performance Gift Certificate
Runner Up (Casey Stoner Award / 2007-2008 Superbikes and Desmosedici RR)—$500 Ducati Performance Gift Certificate
Runner Up (Ducati "Bella" Award / external beauty)—$500 Ducati Performance Gift Certificate
Runner Up (Ducati Passion Award / must be ridden in, miles will be considered)—$500 Ducati Performance Gift Certificate
A bike cannot win the same award more than one time over the course of the five 2008 Ducati Superbike Concorso rounds with the exception of People's Choice. A bike cannot with more than one award in a single Ducati Superbike Concorso round with the exception of People's Choice. Each Ducati Superbike Concorso round will produce ONE Grand Prize winner.
Grand Prize airfare to Italy will include only round-trip coach air transportation from nearest major airport to the winner's residence. Value of travel prize will vary depending on departure location. Flights and hotel accommodations shall be determined by Ducati North America, are subject to availability and are non-transferable. No credit changes or refunds are allowed. All tickets are subject to the vagaries of flight variation, work stoppages and schedule changes. Each winner is responsible for all costs and assessments not specifically enumerated herein including without limitation taxes, meals, tips, ground transportation and insurance. Travel arrangements must be made through Ducati North America's designated travel agent, and travel must occur on dates arranged by Ducati North America or all prizes will be forfeited. All travel plans for winner must be made with Ducati North America's travel department or designated travel agent at least 30 days prior to departure. No substitution or transfer of any of the prizes by the winners is permitted, although Ducati North America reserves the right to substitute a prize of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated.
14. Each winner will be required to sign and return a release of liability, declaration of eligibility, and, where lawful, a publicity consent agreement, all within 10 business days of acknowledged notification. By accepting and/or using any prize, winner agrees to the use of winner's name, voice, and/or likeness as well as images and/or likeness of the winner's bike for the purpose of advertising, trade, or Contest of Ducati North America without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited at Ducati North America's discretion and an alternate winner will be selected.
15. ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZES ARE THE SOLE RESPONSIBILITY OF EACH WINNER.
16. By entering, each entrant agrees to be bound by these Contest rules and the decisions of Ducati North America, which shall be final. Ducati North America reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Ducati North America's reasonable suspicion, tampers with Ducati North America's site, the entry process, violates these Contest rules, or acts in an unsportsmanlike or disruptive manner. Ducati North America, agents, and representatives of Ducati North America, their parents, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Ducati North America that may cause the Contest to be disrupted or corrupted; (v) any lost or damaged bikes; (vi) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest; or (vii) any printing or typographical errors in any materials associated with the Contest. Ducati North America reserves the right, in its sole discretion, to suspend or cancel Contest at any time, including in the event that the administration, security, or proper play of the Contest is violated.
17. DUCATI NORTH AMERICA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO RELEASE AND HOLD DUCATI NORTH AMERICA AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, REPRESENTATIVES OF DUCATI NORTH AMERICA, THEIR PARENTS, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION, AND FULFILLMENT AGENCIES, AND LEGAL ADVISORS, HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND IN CONNECTION WITH THE CONTEST OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY.
18. Ducati North America collects personal information from you when you enter the Contest. Please review Ducati North America's privacy policy at http://ducatiusa.com/ before you enter the Contest. Ducati North America reserves the right to use and transfer any and all information related to the Contest, including information obtained through the Contest, for marketing purposes or any other purpose, in accordance with its privacy policy.
19. The Contest and the rights and obligations of Ducati North America and participants will be governed and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of California, Santa Clara County. The parties consent to the jurisdiction of the state courts of California and federal court located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of the Contest.
20. Ducati North America reserves the right to alter the rules to the Ducati Superbike Concorso at any time for any reason.
